Article 1. General provisions
Rewind offers its users (hereinafter the “Users”) digital tours accessible via the Rewind application (hereinafter the “Services”).
These Services may be free or paid and are available through the Rewind mobile application downloadable from Google Play and the App Store (hereinafter the “Application”). They are collectively referred to as the “Rewind Services” or the “Services”.
The Website and the Application are published and operated by Rewind (hereinafter “Rewind”), a simplified joint-stock company (SAS) with a share capital of €12,759, registered with the Paris Trade and Companies Register under number 843984337, with its registered office at 95 avenue du Président Wilson, 93100 Montreuil, France.
Use of the Services is strictly subject to prior acceptance, without restriction or reservation, of these Terms of Use (hereinafter the “Terms”).
These Terms define the conditions of access to and use of the Rewind Services and govern the contractual relationship between the User and Rewind.
Rewind reserves the right to modify these Terms at any time and at its sole discretion. Users will be informed of such modifications via the Website or the Application.

Article 2. Definitions
“Account”: a personal space dedicated to a User allowing them, through login credentials, to access the Services.
“User”: any natural person using the Services.
“Content”: all audio, visual, audiovisual, textual, graphic, photographic elements, etc., provided, transmitted or published by Rewind or its partners via the Website or the Application, in any form, including podcasts, text, images, videos or audio content.
Article 3. Access and use of the Services
Access to the Services is possible via a compatible mobile device after downloading and installing the Application.
The Application is compatible with recent operating systems, including iOS and Android. Certain features may require up-to-date versions of these systems.
Access to the Services may require an Internet connection. Users are responsible for obtaining and maintaining such connection. A mobile data connection is recommended.
Access to certain Services may require the creation of a user account.
When using certain Services, an “anonymous user account” may be automatically created to allow immediate access to the Application’s features.
Users may complete their registration at any time by creating an account linked to an email address.
Registration is free and may grant access to free content, as specified in the Application. Some features may be subject to payment.
Registration is reserved for adults or minors with the authorization of their legal guardian. It is strictly personal, and each User may only hold one Account.
Users undertake to provide accurate information and to keep it up to date.
Users are responsible for maintaining the confidentiality of their login credentials and for all activities carried out through their account.
In the event of loss, theft or security breach, Users must immediately contact Rewind at bonjour@rewindstories.com. Users remain solely responsible for any use of their account until it is deactivated and release Rewind from any liability in this regard.
Article 4. Description of the Services
The Services provide access to Content (in particular audio content such as podcasts) presenting tourist, historical or unusual places.
These contents are available through themed walking routes using real-time geolocation technologies (the “Tours”).
Tours typically last between 45 minutes and 1 hour 30 minutes. Users can follow the route on their device and benefit from automatic audio playback based on their geographic position.
While using the Application, Tours may be suggested via notifications based on geolocation, provided notifications are enabled. Users may also manually select Tours or use GPS navigation to reach the starting point.
Most features of the Application rely on geolocation and user movement tracking. These features cannot function without enabling such technologies (see Privacy Policy).
Availability and modifications
The Services are generally available 24/7, subject to the conditions set out herein and Article 8.
Rewind may temporarily suspend access to the Services without prior notice or compensation:
- To perform updates, improvements or modifications to the Services, interface or design;
- To carry out maintenance operations.
Users waive any claims against Rewind in this regard.
Article 5. Pricing – No right of withdrawal
5.1 No right of withdrawal
In accordance with applicable consumer law, the right of withdrawal does not apply to digital content supplied without a tangible medium where execution has begun with the User’s prior consent and express waiver of their withdrawal right.
5.2 Purchases – Duration
Users may access the Services through one-time purchases made via the Application.
Such purchases grant access to the purchased Services as long as the User maintains an active Account.
5.3 Prices
Prices are indicated in euros, including all taxes.
Rewind reserves the right to modify pricing at any time. The applicable price is the one in force at the time of purchase.
Payments are processed via the Apple App Store or Google Play platforms, whose terms and conditions apply.
Payments are made in advance.
Article 6. Legal capacity
Users declare that they have the legal capacity to accept these Terms, meaning they are of legal age and not subject to legal protection measures, or, if minors, that they have obtained authorization from their legal guardian.
Article 7. Territory
The Services are accessible worldwide.
Article 8. Liability
Rewind undertakes to provide the Services with reasonable care and skill (best-efforts obligation).
The Services rely on third-party technologies beyond Rewind’s control. Rewind shall not be held liable for technical issues such as GPS failures, hosting issues or maintenance downtime.
Rewind is not responsible for third-party applications, content or advertisements.
Users are responsible for securing their devices and protecting them against malware.
Rewind shall not be liable for incompatibility between the Services and the User’s equipment.
Rewind shall not be liable in cases of force majeure (including but not limited to disasters, strikes, system failures).
Users are solely responsible for how they use the Services and for complying with applicable laws (including traffic regulations).
Users agree to indemnify Rewind against any claims arising from their use of the Services.
Certain Services may be provided by third-party partners. In such cases, Rewind acts solely as a distribution platform and shall not be held liable for such services.
Article 9. Intellectual property
The Website, the Application and all associated content are the exclusive property of Rewind and/or its partners and are protected by intellectual property laws.
Any reproduction, representation or use without prior authorization is strictly prohibited.
Rewind grants Users a non-exclusive right to use the Services strictly for personal use.
Article 10. Severability
If any provision of these Terms is held invalid, the remaining provisions shall remain in full force and effect.
Article 11. Governing law and disputes
These Terms are governed by French law.
In the event of a dispute, the parties shall first seek an amicable resolution.
If no agreement is reached, disputes shall be submitted to the competent courts under applicable law.
Users are informed that they may also resort to mediation or alternative dispute resolution mechanisms.
